executive action not to secure the border. right? not to put more enforcement measures and deterrence at the border to protect americans, but to allow folks that came here illustrate legally work authorization and other benefits. so i think it's really telling about the timing here. and the over point i would make here is there is already a provision in immigration law that allows illegal alien spouses who are married to u.s. citizens to cure their unlawful presence here in the u.s. there is already a process in place. this executive action is actually unnecessary, i think it's more for a headline and more for the president to show, perhaps, the left wing of his party that he is doing something to help illegal aliens. >> brian: so there is another stat i want to share with you that bill melugin was able to get. non-detained docket cases. when you guys left office 3.2 million. now it's up to 7.4 million. describe what that means. these people are just here? waiting for a day in court?

>> well, yeah. so the non-detained docket means exactly that. they are not detained. illegal aliens that come in. they are not being held in mandatory detention. instead, being released into a american communities and asked to show up at a court date at a later time and so that docket continues to grow. but i think what the most important point about this is the data shows that individuals on the non-detained docket are never -- almost never removed while those that are in detention are almost always removed. so, if you are end goal is to remove individuals that don't have a legal right to be here. then the detention capability and capacity is absolutely critical and putting them on this non-detained docket does little, if anything, to actually afact checkiated a removal. >> brian: right. eventually in theory they are going to get in front of a judge. right? >> in theory, absolutely. but, what we know is a lot of them don't ever show up for those court dates. >> brian: also, you point out

too in terms of ratio, one border agent for every 7,000 people that try to cross. that ratio is unsustainable. just a quick note on victor antonio hernandez the el salvadorian killer, gang member accused of killing rachel morin, this is what we found out. he first tried to cross the southern border in el paso in january '23. second time he tried it again in new mexico, and the third time again in new mexico. failed all three times. somehow on the fourth time he was one of those people that we did not see. the so-called got-aways who evaded capture and then he went and killed. what do you take from this? >> well, what that tells me is that the biden administration, if they actually encountered him during the first three times didn't put an order of removal on him and simply pushed him back into mexico, which allowed him to cross again and again and again without any fear of repercussions. you've got to bring deterrence back into the system and so you have got make it more difficult
